Munich, January 11, 2018, EMS Electro Medical Systems S.A., Switzerland, the German market leader with AIR-FLOW® powder jet devices for professional dental cleaning and AIR-FLOW® powders, represented by their law firm Müller Schupfner & Partner, Munich, achieved a first victory against Dürr Dental AG, Germany, in the legal dispute over the powder jet handpiece Lunos® MyFlow.
At the request of EMS, the Hamburg Regional Court prohibited Dürr Dental AG inter alia from advertising powder jet handpieces for subgingival use (i.e., below the gum line or in the gingival pockets) in various promotional documents as long as said handpieces are only approved for the supragingival regions (i.e., above the gum line and not in the gingival pockets) in accordance with their CE marking (order of November 11, 2017, file number 312 O 426/17). This decision has become legally binding after Dürr Dental rendered a final declaration.
